The Diarra Case


The CJEU ruling of 4 October 2023 raises critical concerns regarding the compatibility of certain provisions of the FIFA Regulations on the Status and Transfer of Players (RSTP) — particularly those governing the termination of contracts without just cause — with fundamental EU principles on freedom of movement for workers and competition law. The webinar reviews the legal reasoning adopted by the Court and the subsequent interim amendments introduced by FIFA.


The FIFA Football Agent Regulations (FFAR)


Introduced in 2023, the FFAR have sparked widespread legal challenges, especially in relation to provisions on agent licensing, remuneration caps, and data processing. A preliminary ruling request currently pending before the CJEU examines these regulations under EU competition law, the freedom to provide services, and the General Data Protection Regulation (GDPR). The discussion includes the Advocate General’s forthcoming opinion and FIFA’s interim measures.


The Seraing Case


Although centered on third-party ownership of players' economic rights, this case brings to the forefront broader issues concerning the binding nature of CAS awards and the possibility of their review by national courts to assess compliance with EU law. The potential impact on the global system of sports arbitration is substantial, particularly if the Court upholds the Advocate General’s conclusions issued on 16 January.
